en un hospital público en Lima, se estableció que se trataba de un feto
anencefálico, por lo que el médico tratante le informó sobre la anomalía que
sufría el feto y los riesgos contra su vida en caso de continuar con el
embarazo, señalándole dos opciones: continuar o interrumpir la gestación.
La autora decidió por la segunda opción para lo cual se le practicaron los
estudios clínicos necesarios, los cuales confirmaron el padecimiento del feto.

madre para ser internada para la intervención, el director le informó que no era
posible realizar la interrupción de la gestación, por cuanto hacerlo sería
contravenir a las normas legales.</FONT></SPAN></P>

color=#000000 size=3>Con una demora de tres semanas respecto a la fecha prevista
para el parto, KLL dio a luz una niña anencefálica, que vivió cuatro días;
período durante el cual debió amamantarla. Después de la muerte de su hija ella
se sumió en un estado de profunda depresión. </FONT></SPAN></P>

por las organizaciones DEMUS, CLADEM y “Center for Reproductive Law and Policy”,
KLL presentó la denuncia ante el Comité de Derechos Humanos alegando violación a
los </SPAN><SPAN lang=ES-PE style="FONT-FAMILY: Arial"><FONT
color=#000000>derechos a un recurso efectivo; derecho a la igualdad entre
hombres y mujeres; derecho a la vida, derecho a no ser sometido a tratos crueles
inhumanos o degradantes; derecho a no ser objeto de injerencias arbitrarias o
ilegales en su vida privada; derecho a las medidas de protección que la
condición de menor requiere y derecho a la igualdad ante la ley contemplados en
los artículos 2, 3, 6, 7, 17, 24 y 26 de Pacto Internacional de Derechos Civiles
y Políticos.</FONT></SPAN></FONT></P>

reunido el 24 de octubre de 2005, dictaminó que el Estado Peruano tiene la
obligación de proporcionar a KLL un recurso efectivo que incluya una
indemnización por las violaciones cometidas a sus derechos, además de adoptar
medidas para evitar que se cometan situaciones semejantes en el futuro.

virtud de haber ratificado el Pacto Internacional de Derechos Civiles y
Políticos y su Protocolo Facultativo, para lo cual el Comité le ha otorgado un
plazo de 90 días para que informe sobre las medidas que haya adoptado para dar
cumplimiento al fallo. </FONT></SPAN></P>
