LA FUNDACIÓN SOBREVIVIENTES MANIFIESTA SU SOLIDARIDAD A LA FAMILIA DE
MINDI RODAS, ESPECIALMENTE A SU SEÑORA MADRE Y SU PEQUEÑO HIJO

ANTECEDENTES:
Como es del conocimiento de la opinión pública Mindi fue objeto de un
atentado contra su vida en el 2009 por parte de su esposo, ocasionándole
serias heridas en su rostro, acción ejercida en algunos lugares desde
tiempos antiguos para aislar a la mujer de la sociedad.
Constituyéndose esta practica en una aberración y un total acto de
menosprecio a las
mujeres. A pocos meses de acontecido este hecho, Mindi llego a nuestras
oficinas a solicitar apoyo legal para llevar ante la justicia a su
agresor, ya que él se encontraba gozando de libertad al haber tipificado
el juez como lesiones la agresión sufrida y, concederle una medida
sustitutiva de Q1,000.00. El origen de esta agresión fue la solicitud de
Mindi de una pensión alimenticia para su pequeño hijo.

Al asumir la Fundación Sobrevivientes el caso, se procedió a solicitar el
cambio de tipificación del delito por femicidio en grado de tentativa,
proceso en el cual se nos unió la Defensoría de la Mujer Indígena -DEMI-.
Posteriormente se recusó al juez ya que éste en un medio de comunicación
escrito emitió opinión sobre el caso y los hechos acontecidos; tratando de
justificarlos. Quedó evidenciada la posición prejuiciada que se tenía de
Mindi y por lo tanto se preveía que no se iba a alcanzar justicia. El caso
se trasladó a Jutiapa y se programó el juicio para el 16 de junio de 2011;
dos años después de acontecido el hecho.

Simultáneamente, por parte del equipo de la Fundación, se le brindó apoyo
psicológico. Posteriormente esta atención fue proporcionada a través de
una profesional externa. Así mismo, al salir a luz pública el caso, se
presentaron varios ofrecimientos para la reconstrucción de su rostro;
tanto por parte de profesionales nacionales que ofrecieron hacerlo de
forma solidaria, como de profesionales mexicanos. Mindi se entrevisto con
cada uno de ellos; cada quien le explicó el procedimiento a realizar y las
opciones existentes tomando en cuenta varios aspectos. Fue ella quien
decidió viajar a México para someterse al tratamiento de reconstrucción
facial. Esto acontece en el mes de enero del 2010 aproximadamente, con el
apoyo de: La Primera Dama y de las autoridades del mexicanas.

Durante su estadía en la hermana República de México, Mindi mantuvo
comunicación permanente con su familia y con la Fundación; las autoridades
guatemaltecas diariamente reportaban el desenvolvimiento del proceso. Cabe
señalar que todo esto fue difícil para Mindi porque no solo presentaba un
cuadro de stress post-traumático, sino otras afectaciones, que no podían
ser superadas sin un tratamiento sistemático.
Mindi decidió regresar a Guatemala, antes de terminar el proceso de
reconstrucción facial.Decisión que respetamos. Porque siempre mantuvimos
la idea de que: Sí bien a ella le habían mutilado su rostro, no le habían
mutilado sus capacidades de toma de decisión, ni su amor a la vida, a la
libertad.

Posterior a su llegada nos vimos en la necesidad de solicitarle que
estuviera en el albergue (espacio que la Fundación brinda en determinados
casos a nuestras usuarias) para poder cuidar de sus heridas, para evitar
infecciones, ya que se requería de curaciones diarias. En el mes de julio,
por venir su cumpleaños, ella planteó que quería pasarlo en su comunidad y
que deseaba salir del albergue. Como la estadía es voluntaria y no podemos
retener a nadie contra su voluntad; tras hacerle una celebración en la
Fundación, se trasladó a su casa, habiendo coordinado con el centro de
salud de la comunidad para que recibiera las curaciones que aún quedaban
pendientes. Es de mencionar que en su momento Mindi no aceptó el estatus
de testigo protegida pues esta situación implicaba limitaciones para su
movilidad y vida personal. Tratamos, en la medida de nuestras
posibilidades, de brindar el acompañamiento a su mamá y a su pequeño hijo;
quien estaba bajo el cuidado de su abuelita. La última comunicación la
tuvimos aproximadamente a finales de noviembre, en donde le reafirmamos
que el apoyo continuaba para el proceso de reconstrucción de su rostro,
para lo cual se estaban considerando opciones en el país.

Como Fundación siempre tuvimos claridad que aparte del proceso legal,
teníamos que apoyar a Mindi en la parte de reconstrucción de su rostro
para que pudiera tener verdaderas opciones de vida. Con su puño y letra
ella empezó a escribir su historia y lo que ella proyectaba hacia
adelante. Mindi, a través de compartir su testimonio, encontró una forma
de ayudar a otras mujeres para que se animaran a romper el silencio.

Cada una de las actuaciones por parte de Fundación Sobrevivientes esta
documentada. La Fundación brinda el apoyo a solicitud de la víctima o sus
familiares, apoyamos hasta donde ellas lo permiten; y toda participación
pública es con su pleno consentimiento. No percibimos ningún beneficio
económico, al contrario, cada caso requiere de toda una inversión, que
gracias al apoyo de nuestros donantes es posible, porque todo el servicio
es totalmente gratuito.

SITUACIÓN ACTUAL:
Mindi salió de su casa el día 17 de diciembre. Al final de la tarde tuvo
la última comunicación, manifestando que se encontraba bien. El día 18 su
familia trató de comunicarse pero ya no contestó el teléfono. De acuerdo a
lo narrado por su familia, trataron de establecer con conocidos si la
habían visto; acudieron a presentar la denuncia la sede del Ministerio
Público de Cuilapa y con la Policía Nacional Civil.

El 17 de enero se apersonaron a la morgue del INACIF de la ciudad capital
e identifican su cadáver, el cual se encuentra sepultado como XX en el
Cementerio la Verbena. De acuerdo a los informes policiales su cuerpo
apareció el 18 de diciembre a las 8 A.M. en la zona uno de la ciudad
capital. Desconocemos porqué se encontraba en la ciudad. Es hasta el 17 de
enero que la mamá de Mindi, acompañada de representantes de la
Defensoría de la Mujer (de la Procuraduría de los Derechos Humanos), llega
a la sede de la Fundación y nos informa de lo sucedido. Desde ese momento
Fundación Sobrevivientes coordina acciones con el Ministerio Público;
estamos ya constituidas como querellantes adhesivas.

Esperamos contar con el apoyo de la población guatemalteca para avanzar en
las investigaciones que nos lleven a los responsables, pues a Mindi le
quitaron la vida con violencia, con la misma violencia con que la que le
quitaron su rostro. La asesinaron por su condición de Mujer.

El debate por el intento de femicidio se mantiene, su muerte no tiene
porque afectar el proceso. Lamentamos profundamente que Mindi no haya
logrado ver la justicia. Ella esperaba con ansias ese día. Nos disculpamos
por no habernos pronunciado antes, pero necesitábamos priorizar las
investigaciones y el acompañamiento a su mamá y su hijito.

Mindi Rodas has been killed

At the end of 2009, four reporters of LA Ruta and Noticias went to
Guatemala City to report on the killings of women. We interviewed Mindi
Rodas, a woman from Guatemala who was abused by her husband. In doing so,
he severely mutilated her face. Now, one year later Mindi Rodas has been
killed by an unknown killer.

At the time, we met Mindi at Sobrevivientes, an organization in Guatemala
that helps victims of violence against women and family members of killed
women. Just before we met her, Mindi decided to tell her story. In doing
so, she hoped to convince women who were suffering abuse to leave their
husbands. Mindi wanted to prevent other women from becoming a victim of a
similar crime. During the interview, Mindi wore a mask to cover her
mutilated face. Because of the severe mutilation she could no longer walk
the streets freely.

Inspite of everyting, Mindi had faith in the future and she was willing to
do anything in the fight for justice for her and for all the other victims
of murder and violence against women. When we spoke with her, her eyes
were radiant with energy, courage and life. Her story made a profound
impact on us.

Last week, LA Ruta received the sad news that Mindi has been killed in
Guatemala City. She was found on December 18. It is yet unclear who the
perpetrator is. Our thoughts and deep condolences go out to her mother and
her son.

We deeply regret the murder of Mindi. She managed to escape death once but
sadly se couldn’t the second time. Unfortunately, this is the sad faith of
many women in Guatemala. We will never forget this courageous woman and we
hope that, thanks to the report we made on her, her story will not be
forgotten.

Foundation Survivors expresses their solidarity to the family of Mindi
Rhodes, especially to her mother and her young son.

Background:
As is known to the public, Mindi was the victim of an assassination
attempt by her husband in 2009, causing serious injuries to her face.
These kinds of attempts takes place in several places since ancient times.
It aims to isolate women from society. These attempts are an absolute
aberration and an act of total disrespect to women.

A few months after the attack, Mindi came to our office to ask for legal
help to bring her attacker to justice as he was free to go after he
threatened the judge who gave him a replacement penalty of Q 1,000.00. The
reason for the threats and acts of aggression against the judge was the
fact that Mindi requested money to nurture her young son.

When Foundation Survivors took on the case, we requested to change the
definition of the crime committed to Mindi into attempted femicide. We
were joined in the trial by the Defenders of Indiginous Women (DEMI).
Later on, there were protests against the judge because he expressed his
opinion on the case and the events trying to justify them. It was clear
that Mindi’s position was prejudiced and therefore she would probably not
achieve justice.

The case was transferred to Jutiapa and the trial was planned on June 16
of 2011, two years after the attack on Mindi’s life. Meanwhile, Mindi
received psychological support from Foundation Survivors through an
external professional. Also, when the case got out in public, Mindi
received various offers to reconstruct her face, both by professionals
from Guatemala as professionals from Mexico. Mindi met every one of them
and they explained the surgery and various options. Mindi decided to
travel do Mexico to undergo the facial reconstruction procedure. This took
place in January 2010, with the help of the First lady and the Mexican
authorities.

During her stay in Mexico, Mindy stayed in touch with her family and with
Foundation Survivors. The Guatemalan authorities reported about Mindi on a
daily base. This was all very hard for Mindi. Not only did she suffer from
traumatic stress, but also from other difficulties that she would not be
able to overcome without systematic treatment.

Mindi decided to return to Guatemala, before the reconstruction surgery
was completed. We respect this decision because we always thought that,
although her face had been mutilated, this did not affect her ability to
take decisions, neither her love for life and liberty.

Afther her return, we found it necessary for her to stay in a hostal we
provide for our clients to treat her wounds to prevent infections. In
July, with her birthday coming up, she wanted to leave the hostel and
spend her birthday in her community. We couldn’t deny her this, so afther
a birthday celebration at our Foundation, we took her home and coordinated
with community’s health centre that Mindi would get the treatment she
needed.

At that time, Mindi did not accept the protected witness status because
this would imply restrictions for her personal life. We accompanied Mindi
to her mother and her young son. The latter was under the care of his
grandmother. The last time we talked to Mindi was at the end of November.
We assured her that she had full support to continue the facial
reconstruction in her own country.

As a Foundation, it was always clear to us that, apart from the legal
process, we would support Mindi in her facial reconstruction so that she
would have better opportunities in live. Mindy began to write down her
story and her thoughts about her future. By sharing her testimony with
other women, she could help them break the silence.

Every act of Foundation Survivors is documented. The Foundation provides
support by the request victims or her relatives request. We support them
any way we can, and we go as far as they allow us to go. All public
involvement is with their full consent. We do not earn any money by
helping. On the contrary, every case requires a large investment that is
made possible thanks to the support of our sponsors. All our services are
absolutely free of charge.

Actual situation:
Mindi left her home on December 17. The last time anyone heard from Mindy
was late that evening, saying she was fine. On December 18, her family
tried to get in contact with her but she did not answer her telephone.
According to her family, they asked acquaintances whether they had seen
her. After that, Mindi’s family went to the police and the prosecutor to
report her missing. On January 17, Mindi’s body was identified and brought
to the morgue. They buried her at the Verbena Cemetery as XX. According to
police reports, her body was found on December 18 at 8 A.M. in zone 1 of
the capital. We do not know why she went to town. It was not until January
17 that Mindi’s mother, accompanied by representatives of the Advocacy for
Women (of the Human Rights Watch), came to our office and told us what
happened. From that moment, Foundation Survivors coordinates her actions
with the Prosecution. We are also established as plaintiffs.

We hope we can count on the support of the Guatemalan population in the
investigations leading to those responsible for Mindi’s death. Mindi’s
life was taken violently in the same way her face was taken from her. She
was murdered because of her womanhood.

The debate for the attempted femicide goes on. Mindi’s death will not
affect this. We deeply regret that Mindi never succeeded in finding
justice. She was really looking forward to that day.

We apologize for not having spoken up before, but we had to give priority
to the investigations and supporting Mindi’s mother and her son. And we
are also extremely concerned. It has been a very tough start of a new year
for all the lives that violence has taken.

Stad geweest om een reportage te maken over vrouwenmoorden. Daar hebben
wij Mindi Rodas geïnterviewd, een Guatemalteekse vrouw die was mishandeld
door haar man. Hierbij heeft hij haar gezicht ernstig verminkt. Nu, een
jaar later, is Mindi Rodas door een nog onbekende dader vermoord.

Wij hebben Mindi ontmoet bij Sobrevivientes, een organisatie in Guatemala
die slachtoffers van vrouwengeweld, en familieleden van vermoorde vrouwen,
ondersteunt. Ze had vlak voor onze komst het besluit genomen om haar
verhaal openbaar te maken. Zij hoopte hiermee andere vrouwen te overtuigen
de mannen die hen mishandelen te verlaten. Op die manier wilde ze helpen
voorkomen dat andere vrouwen ook slachtoffers zouden worden van een
soortgelijk misdrijf. Ten tijde van ons interview droeg zij een masker
voor haar gehavende gezicht. Vanwege de ernstige verminkingen kon ze
bovendien niet meer vrij rondlopen op straat.

Ondanks alles had Mindi vertrouwen in de toekomst en was bereid al het
nodige te doen in de strijd voor gerechtheid voor haar en alle andere
slachtoffers van moord en geweld tegen vrouwen. Toen we haar spraken,
straalden haar ogen energie, moed en levenslust uit. Haar verhaal heeft
diepe indruk op ons gemaakt.

Vorige week ontving LA Ruta het trieste bericht dat Mindi is vermoord in
Guatemala stad. Op 18 december is ze gevonden. Vooralsnog is onduidelijk
wie de dader is. Ons intense medeleven gaat uit naar haar moeder en
zoontje.

Wij betreuren de moord van Mindi enorm. Ze was één keer aan de dood
ontsnapt maar een tweede keer is het haar niet gelukt. Het is helaas het
trieste lot van veel vrouwen in Guatemala. Wij zullen deze dappere vrouw
nooit vergeten en hopen dat de video die wij van haar maakten, ertoe zal
bijdragen dat ook haar verhaal nooit vergeten wordt.

Hieronder publiceren wij de brief die wij ontvingen van Sobrevivientes

De organisatie Sobrevivientes spreekt haar solidariteit uit met de familie
van Mindi Rodas, in het bijzonder aan haar moeder en zoontje.

Voorgeschiedenis
In 2009 is Mindi slachtoffer geworden van aan aanslag op haar leven
gepleegd door haar echtgenoot die haar ernstige verwondingen aan haar
gezicht toebracht. De aanleiding voor deze agressie was Mindi’s verzoek
voor alimentatie voor haar kleine zoontje. Soortgelijke gewelddadigheden
komt in bepaalde streken al jaren voor en is bedoeld om vrouwen uit te
sluiten van de maatschappij. Deze veelvoorkomende en verschrikkelijke daad
getuigt van totale minachting van vrouwen in het algemeen.

Een paar maanden vóór deze gebeurtenis klopte Mindi bij ons kantoor aan
voor juridische hulp om haar aanvaller voor het gerecht te brengen,
aangezien hij in alle vrijheid rondliep. De rechter had de agressieve daad
als mishandeling aangemerkt en hem eerder een vervangende straf van
omgerekend € 100 toegekend.

Toen de organisatie Sobrevivientes deze zaak op zich nam, verzocht ze het
delict om te zetten in poging tot vrouwenmoord en tijdens dit proces
voegde DEMI (Verdediging van Inheemse Vrouwen) zich bij ons. Naderhand
wraakten ze de rechter, aangezien hij in een geschreven mediabericht zijn
mening verkondigde over de zaak en de feiten die hadden plaatsgevonden in
een poging deze te rechtvaardigen. Het was duidelijk dat hij
bevooroordeeld was ten aanzien van Mindi en daarom voorzag men dat hij
niet tot een rechtvaardig oordeel zou komen. De zaak werd aan Jutiapa
overgedragen en de zitting werd voor 16 juni 2011 ingepland; twee jaar
nadat het delict had plaatsgevonden.

Tegelijkertijd werd psychologische hulp aangeboden aan Mindi door een team
van de organisatie. Deze zorg ontving ze later van een externe
professionele hulpverlener.

Doordat haar zaak in de publiciteit kwam, werden haar ook verschillende
aanbiedingen gedaan voor de reconstructie van haar gezicht; zowel van
specialisten uit eigen land, die dit uit solidariteit aanboden, als van
Mexicaanse specialisten. Mindi sprak met elk van hen; ieder legde haar de
procedure en de bestaande opties uit, rekeninghoudend met de verschillende
aspecten. Ze nam zelf de beslissing om naar Mexico te reizen om een
behandeling te ondergaan voor een gezichtsreconstructie. Dit was rond
januari 2010, met de hulp van: de first lady en de Mexicaanse
autoriteiten.

Tijdens haar verblijf in Mexico had Mindi veelvuldig contact met haar
familie en Sobrevivientes en de autoriteiten van Guatemala rapporteerden
dagelijks over de ontwikkeling van het proces. Het hele proces was zwaar
voor Mindi, want ze had niet alleen last van zware posttraumatische
stress, maar ook van andere aandoeningen die niet zonder structurele
behandeling konden worden genezen.

Voordat het proces van haar gezichtsreconstructie was beëindigd, besloot
Mindi naar Guatemala terug te keren. Een beslissing die wij respecteren.
Want we hebben altijd gevonden: ook al hebben ze haar gezicht verminkt, ze
hebben haar capaciteiten om zelf beslissingen te nemen niet verminkt, noch
haar liefde voor het leven, of de vrijheid.

Na naar terugkomst hebben wij haar onderdak geboden om zo te kunnen
herstellen van haar wonden. Ze had dagelijkse verzorging nodig om
infecties te voorkomen.
In de maand juli, met haar verjaardag op komst, gaf ze te kennen dat ze
deze in haar eigen omgeving wilde doorbrengen en wilde vertrekken uit de
plaats waar ze logeerde. Haar verblijf was op vrijwillige basis en we
kunnen niemand tegen haar zin vasthouden: nadat we haar verjaardag bij de
organisatie gevierd hadden, verhuisde ze naar haar eigen huis. Ze had
afspraken gemaakt met het gezondheidscentrum van haar eigen gemeenschap om
de zorg te krijgen die ze nog nodig had. Mindi was niet bereid om de
status van beschermde getuige te accepteren, omdat die situatie beperking
van bewegingsvrijheid en beperkingen voor haar privéleven inhield.

We probeerden, binnen onze beperkte middelen, gezelschap te bieden aan
haar moeder en zoontje, dat aan de zorgen van z’n oma was toevertrouwd.
Ons laatste contact dateerde ongeveer van eind november en hierin
verklaarden we opnieuw dat we haar bleven ondersteunen met het proces van
haar gezichtsreconstructie. Voor ons als organisatie was het altijd
duidelijk dat we Mindi, naast het juridische proces, ook moesten helpen
met haar gezichtsreconstructie, zodat ze weer kans op een echt leven
maakte.

Ze begon eigenhandig haar verhaal te schrijven en maakte plannen voor haar
toekomst. Door haar verhaal te delen, vond Mindi een manier om andere
vrouwen te helpen om ook hen aan te sporen de stilte te doorbreken.

Alle stappen van de organisatie Sobrevivientes staan geregistreerd. De
organisatie biedt op verzoek van slachtoffers of hun familie hulp, we
helpen daar waar ze ons laten helpen; en alle publieke berichtgeving is
met hun volledige instemming. Wij ontvangen geen enkele structurele
financiële hulp. Iedere zaak juist een investering, die dankzij de hulp
van onze donateurs mogelijk wordt gemaakt; alle hulp die wij bieden is
volledig gratis.

Huidige Situatie:
Op 17 december verliet Mindi haar huis. Aan het eind van de middag had ze
voor het laatst contact, waarin ze aangaf dat het goed met haar ging. Op
18 december probeerde haar familie Mindi te bereiken, maar ze beantwoordde
haar telefoon niet. Haar familie probeerden er via kennissen achter te
komen of ze haar gezien hadden en deden uiteindelijk aangifte bij het
Openbaar Ministerie van Cuilapa en bij de Nationale Politie.

Op 17 januari heeft de familie van Mindi heeft haar lichaam eindelijk
kunnen identificeren in het mortuarium in de hoofdstad. Haar lichaam ligt
nu begraven als XX op de begraafplaats Verbena. Volgens de
politie-informatie werd haar lichaam op 18 december om 8:00 uur ontdekt in
zone 1 van de hoofdstad. Waarom Mindi zich in de hoofdstad bevond weten we
niet.
Op 17 januari komt de moeder van Mindi, in gezelschap van
vertegenwoordigers van de organisatie ter Verdediging van de Vrouw, naar
ons hoofdkantoor en vertelt ons wat er gebeurd is. Vanaf dat moment
coördineert de organisatie Sobrevivientes de acties richting het Openbaar
Ministerie; we zijn nu de officiële aanklagers.

We rekenen op de hulp van de Guatemalteekse bevolking om voortgang te
boeken met het onderzoek dat ons bij de verantwoordelijken moet brengen.
Want ze hebben Mindi met geweld van het leven beroofd, met hetzelfde
geweld als waarmee ze haar van haar gezicht hebben beroofd. Ze hebben haar
vermoord omdat ze vrouw was.

De controverse over de poging tot vrouwenmoord duurt voort, haar dood doet
daar niets aan af. We betreuren het dat het Mindi niet gelukt is om
gerechtigheid te krijgen. Ze heeft vol spanning naar die dag uitgekeken.

Onze verontschuldigingen voor het feit dat we niet eerder naar buiten zijn
gekomen met dit bericht, maar het onderzoek en het ondersteunen van haar
moeder en zoontje hadden voorrang. Bovendien zijn we zeer aangeslagen, het
was een zwaar begin van het nieuwe jaar door de levens die door geweld
zijn beëindigd.
