sumando sus votos se acercaban a los resultados alcanzados por Evo

operación referida se consideran reproducidos en el presente el informe del
Asesor Jurídico Dr. Braulio Gil, que obra en anexo</FONT></SPAN><FONT
face="Times New Roman"><B style="mso-bidi-font-weight: normal"><SPAN lang=ES-UY
style="FONT-SIZE: 8pt"> </SPAN></B><SPAN lang=ES-UY
style="FONT-SIZE: 8pt">(CARPETA 2)</SPAN></FONT><FONT
face="Times New Roman"><SPAN lang=ES-UY style="FONT-SIZE: 10pt"> destacando los
siguientes conceptos:<BR><SPAN style="mso-spacerun: yes">
</SPAN>Constituye recurso y fuente de financiamiento el producto de empréstitos
u otras operaciones de crédito, lo cual se determina por Decretos del Gobierno
Departamental, se fijan y recaudan por las oficinas en el tiempo y forma que
dichos actos establezcan, luego el mismo cuerpo normativo</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 8pt"> (T<SPAN
style="TEXT-TRANSFORM: uppercase">ocaf</SPAN>)</SPAN></FONT><SPAN lang=ES-UY
style="FONT-SIZE: 10pt"><FONT face="Times New Roman"> recuerda que la
concertación (modo, plazo, etc...) de cualquier operación de crédito, que es
Deuda Pública, se rige por el artículo 301 de <st1:PersonName w:st="on"
ProductID="la Constituci?n">la Constitución</st1:PersonName> de </FONT><FONT
face="Times New Roman"><st1:PersonName w:st="on"
ProductID="la República. ">la República.<BR><SPAN
style="mso-spacerun: yes"> </SPAN></st1:PersonName><SPAN
style="mso-spacerun: yes"> </SPAN>Esta norma en su
inc</FONT></SPAN><SPAN lang=ES-UY style="FONT-SIZE: 9pt"><FONT
face="Times New Roman">. 2</FONT></SPAN><FONT face="Times New Roman"><SPAN
lang=ES-UY style="FONT-SIZE: 10pt"> establece que para contratar préstamos se
requiere iniciativa del Intendente y aprobación de la mayoría absoluta de votos
del total de componentes de <st1:PersonName w:st="on"
ProductID="LA JUNTA DEPARTAMENTAL">la Junta Departamental</st1:PersonName>,
previo informe del Tribunal de Cuentas.<BR><SPAN
style="mso-spacerun: yes"> </SPAN>Debe concluirse que las
sucesivas operaciones de crédito préstamos- que el documento de referencia
revela, fueron contratadas sin el cumplimiento de aquellas prerrogativas
constitucionales al grado de poder entenderse que son nulas (Art</SPAN><SPAN
lang=ES-UY style="FONT-SIZE: 9pt">. 8 </SPAN></FONT><SPAN lang=ES-UY
style="FONT-SIZE: 10pt"><FONT face="Times New Roman">Código Civil).<BR><SPAN
style="mso-spacerun: yes"> </SPAN>Fuera de la formal
infracción de rango constitucional señalada, al cometerse ello, asistimos a una
serie de irregularidades que se han dado reiteradamente en el tiempo y han
determinado la necesaria intervención de otras personas, funcionarios públicos
cuya responsabilidad igualmente podría ser objeto de análisis no obstante la
carga que asume el jerarca, pues es cosa distinta asumir la misma a que luego se
pondere el valor y alcance de ello.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><FONT
face="Times New Roman"><SPAN lang=ES-UY style="FONT-SIZE: 10pt"><SPAN
style="mso-spacerun: yes"> </SPAN>Estando a la consideración
en el tiempo que realiza el ya citado documento período comprendido entre abril
de</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 9pt"> 2004</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 10pt"> y diciembre de</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 9pt"> 2004 </SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 10pt">esto puede implicar mudar el ámbito de examen de la
responsabilidad de personas que se vincularían a los actos comerciales
(préstamos) pues</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 9pt"> el
Sr.</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt"> Carlos Soria se encuentra
ejerciendo el cargo de Intendente desde el</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 9pt"> 31 </SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt">de
julio de</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 9pt"> 2004 </SPAN></FONT><FONT
face="Times New Roman"><SPAN lang=ES-UY style="FONT-SIZE: 10pt">al presentar
renuncia el titular.<BR><SPAN style="mso-spacerun: yes">
</SPAN>Por consecuencia la persona antes citada es el jerarca máximo ahora, pero
también lo asumiría en el tiempo anterior que ahora se dice recurrió a la
modalidad indicada para obtener recursos, pero durante el cual no era el jerarca
máximo de la institución, sino Secretario General de la misma.<BR><SPAN
style="mso-spacerun: yes"> </SPAN>La cesión de crédito en sí
misma no constituye la modalidad que demuestre el haber obtenido el recurso
financiero, sino que admitiría haberlo recibido y sería solo documentación de su
pago, quedándose sin conocer cómo efectivamente se documentaron los
préstamos.<BR><SPAN style="mso-spacerun: yes"> </SPAN>Y hace
la remisión a un documento adjunto que en verdad no podría ser el que
corresponde, obsérvese que la cesión de créditos es del</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 9pt"> 5 </SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt">de
enero del</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 9pt"> 2005</SPAN><SPAN
lang=ES-UY style="FONT-SIZE: 10pt"> pero en cambio el documento efectivamente
agregado consigna ya en su primer página la ejecución de actos posteriores a esa
fecha, del</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 9pt"> 17 </SPAN><SPAN
lang=ES-UY style="FONT-SIZE: 10pt">de enero de</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 9pt"> 2005,</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt">
alcanzando en su segunda página al</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 9pt"> 15</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt"> de
abril de</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 9pt"> 2005.</SPAN></FONT><SPAN
lang=ES-UY style="FONT-SIZE: 10pt"><BR><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>Durante</FONT></SPAN><FONT
face="Times New Roman"><SPAN lang=ES-UY style="FONT-SIZE: 9pt"> 30 </SPAN><SPAN
lang=ES-UY style="FONT-SIZE: 10pt">días se estuvieron efectuando pagos por un
total de</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 9pt"> $
6.025.149</SPAN></FONT><FONT face="Times New Roman"><SPAN lang=ES-UY
style="FONT-SIZE: 10pt"> para cancelar préstamos a través de la modalidad
encubierta de remesas de fondos a <st1:PersonName w:st="on"
ProductID="LA JUNTA LOCAL">la Junta Local</st1:PersonName> de Bella
Unión.<BR><SPAN style="mso-spacerun: yes"> </SPAN> El
contenido de las órdenes de pago de los movimientos- resulta ser falso, es parte
de una maniobra para cerrar la acotada inicial irregularidad.<BR><SPAN
style="mso-spacerun: yes"> </SPAN>Retirados estos dineros para
<st1:PersonName w:st="on" ProductID="LA JUNTA LOCAL">la Junta
Local</st1:PersonName> de Bella Unión pero luego no vertidos allí, ello
determina la responsabilidad de otros funcionarios.<BR><SPAN
style="mso-spacerun: yes"> </SPAN>En definitiva, y aunque no
causare perjuicio económico, nos encontraríamos ante un apartamiento inexcusable
de las normas de contabilidad y administración financieras aplicables, y de los
principios y procedimientos de buena administración, en forma reiterada y
prolongada en el tiempo.<BR></SPAN><B style="mso-bidi-font-weight: normal"><SPAN
lang=ES-UY style="FONT-SIZE: 9pt"><SPAN

del</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 9pt"> Dr.</SPAN></FONT><FONT
face="Times New Roman"><SPAN lang=ES-UY style="FONT-SIZE: 10pt"> Carlos
Signorelli, de la planilla presentada no surge ningún pago por concepto de
capital ni intereses por estos préstamos.<BR><SPAN
style="mso-spacerun: yes"> </SPAN>Resulta difícil suponer que
el</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 9pt"> Dr.</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 10pt"> Carlos Signorelli desconociera esta operativa, pese a
la responsabilidad asumida por el</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 9pt">
Sr.</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt"> Carlos Soria, por cuanto si
bien el primer préstamo reconocido se remonta al último día de una licencia
de</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 9pt"> 11 </SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 10pt">días del</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 9pt">

se reconoce la realización de operaciones de préstamos durante el ejercicio del

Palermo, conformó una comisión con el objetivo de mejorar el barrio. En poco
tiempo, logró involucrar a la comunidad del lugar y desarrollar diferentes
emprendimientos para preservar el importante patrimonio cultural y atender las
problemáticas sociales de la zona.<BR><SPAN
style="mso-spacerun: yes"> </SPAN>Delimitado por
<st1:PersonName w:st="on" ProductID="la Rambla">la Rambla</st1:PersonName>,
Ejido, Jackson y Constituyente, se encuentra Palermo, una zona que contiene un
importantísimo patrimonio histórico palpable, visible y a nivel intangible, una
historia que ha marcado una identidad barrial.<BR><SPAN
style="mso-spacerun: yes"> </SPAN>Hablar de Palermo es
recordar su pasado de barrio receptor de inmigrantes italianos y de población
afro y todo el legado que esa confluencia nos dejó y que perdura en la
actualidad: el candombe, las llamadas y el tango. Pero también hacen a Palermo,
sus casas viejas, conventillos y las escuelas de oficio de <st1:PersonName
w:st="on" ProductID="la UTU">la<SPAN style="FONT-SIZE: 9pt">
UTU</SPAN></st1:PersonName><SPAN style="FONT-SIZE: 9pt">,</SPAN> en donde se
formaron y se siguen formando miles de artesanos, artistas y obreros de nuestro
país.<BR><SPAN style="mso-spacerun: yes"> </SPAN>Una clara
muestra de esta riqueza cultural, fue el circuito de paseos organizado el Día
del Patrimonio, el pasado</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt"> 24
</SPAN></FONT><SPAN lang=ES-UY style="FONT-SIZE: 11pt"><FONT
face="Times New Roman">de setiembre, con nueve puntos para visitar y casi
cuarenta actividades culturales, desarrolladas por los propios vecinos.<BR><SPAN
style="mso-spacerun: yes"> </SPAN>Preocupados por la
preservación del patrimonio barrial, así como la inquietud de mejorar la zona a
nivel social y ambiental, un grupo de vecinos comenzó a reunirse y se constituyó
<st1:PersonName w:st="on" ProductID="La Comisi?n">la Comisión</st1:PersonName>
de Vecinos de Palermo. Uruguay Solidario dialogó con los integrantes de este
grupo, que además son concejales de <st1:PersonName w:st="on"
ProductID="la Zona N">la Zona<SPAN style="FONT-SIZE: 10pt">
N</SPAN></st1:PersonName><SPAN style="FONT-SIZE: 10pt">° 2.</SPAN> María
Cristina Hernández, Estella Barreiro y Héctor Rodríguez hablaron sobre los
diferentes emprendimientos que vienen impulsando desde el año pasado y los
múltiples proyectos e ideas que se han generado a partir de este trabajo
comunitario.<BR><SPAN style="mso-spacerun: yes">
</SPAN></FONT></SPAN><B style="mso-bidi-font-weight: normal"><SPAN lang=ES-UY
style="FONT-SIZE: 9pt; FONT-FAMILY: Arial">Color en el barrio</SPAN></B><SPAN
lang=ES-UY style="FONT-SIZE: 11pt"><BR><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>Para empezar y no es poca
cosa, fue gracias a este grupo de vecinos que las paredes de
Minas</FONT></SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt"><FONT
face="Times New Roman"> (entre Islas de Flores y Durazno) </FONT></SPAN><SPAN
lang=ES-UY style="FONT-SIZE: 11pt"><FONT face="Times New Roman">se llenaron de
color. Una serie de pinturas realizadas por alumnos de la escuela Pedro Figari
muestran imágenes de la cultura afro, el candombe y escenas típicas del barrio.
Y no se trata de sólo de una cuestión estética, porque el trabajo involucró a
los vecinos y a los jóvenes alumnos de la escuela Figari, junto con los
docentes, por lo tanto se obtuvo una mejora del barrio a la vez que los
estudiantes pudieron volcar su arte a la comunidad. "Consideramos a la cultura
como una fuente de inclusión social", señaló Héctor.<BR> <SPAN
style="mso-spacerun: yes"> </SPAN>En este marco, se pensó en la
posibilidad de crear una pequeña peatonal en la calle</FONT></SPAN><SPAN
lang=ES-UY style="FONT-SIZE: 10pt"><FONT face="Times New Roman"> Ntra. Sra. de
<st1:PersonName w:st="on" ProductID="la Encina">la<SPAN style="FONT-SIZE: 11pt">
Encina</SPAN></st1:PersonName></FONT><SPAN style="FONT-SIZE: 11pt"><FONT
face="Times New Roman"> entre Salto y Minas y abrir <st1:PersonName w:st="on"
ProductID="la Escuela Figari">la Escuela Figari</st1:PersonName>, al público y
mostrar el trabajo que allí se realiza. Al mismo tiempo ese tramo, sería
adornado con esculturas de hormigón realizadas por los propios alumnos de la
escuela.<BR><SPAN style="mso-spacerun: yes">
</SPAN></FONT></SPAN></SPAN><B style="mso-bidi-font-weight: normal"><SPAN
lang=ES-UY style="FONT-SIZE: 9pt; FONT-FAMILY: Arial">Niños en la
calle</SPAN></B><SPAN lang=ES-UY style="FONT-SIZE: 11pt"><BR><FONT

</SPAN>Un aspecto que caracteriza a esta zona, es la confluencia de poblaciones
con realidades culturales, sociales y económicas muy distintas. Existe una gran
población de bajos recursos, con problemáticas diversas. Uno de los temas que es
preocupación para los vecinos es la cantidad de niños que desde edades muy
tempranas permanecen en la calle, hasta altas horas de la noche.<BR><SPAN
style="mso-spacerun: yes"> </SPAN>Los entrevistados explican
que por tratarse de una zona con muchas pensiones, los niños que allí habitan
son enviados a la calle "para que no molesten" y entonces pasan muchas horas en
la calle.<BR>En Palermo, al igual que en otros barrios de la capital, el consumo
de drogas se ha convertido en un problema cada vez mayor, involucrando a
adolescentes y a niños, muchos de ellos en situación de calle.<BR><SPAN
style="mso-spacerun: yes"> </SPAN>Por este motivo, la comisión
apoya un programa denominado Club de Niños, una casa en San
Salvador</FONT></SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt"><FONT
face="Times New Roman"> <st1:metricconverter w:st="on" ProductID="1617, a">1617,
<SPAN style="FONT-SIZE: 11pt">a</SPAN></st1:metricconverter><SPAN
style="FONT-SIZE: 11pt"> la que concurren 40 niños de la escuela pública del
barrio. Allí unos</SPAN> 20 </FONT></SPAN><FONT face="Times New Roman"><SPAN
lang=ES-UY style="FONT-SIZE: 11pt">niños del turno de la tarde y los otros del
turno de la mañana, asisten una vez finalizado el horario de clase. Allí reciben
apoyo en las tareas escolares y realizan actividades recreativas. "Se trata de
un lugar de contención y así se evita que los niños permanezcane n la calle",
dice Estella.<BR><SPAN style="mso-spacerun: yes"> </SPAN>La
comisión apoya con material didáctico, además recientemente logró
adquirir</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt"> 2 </SPAN></FONT><SPAN
lang=ES-UY style="FONT-SIZE: 11pt"><FONT face="Times New Roman">computadoras,
por lo tanto se ha previsto que a partir del verano los niños puedan aprender

style="FONT-SIZE: 9pt; FONT-FAMILY: Arial">Afro - descendientes</SPAN></B><SPAN

marginalización y exclusión de la población negra, que generó la demolición de
los dos pilares de la comunidad negra: el Medio Mundo y el Reus, es otro tema
que preocupa a esta comisión.<BR> <SPAN
style="mso-spacerun: yes"> </SPAN>María Cristina, habló sobre otro
de los proyectos que están apoyando. Se trata de la cooperativa de vivienda para
afro descendientes</FONT></SPAN><SPAN lang=ES-UY style="FONT-SIZE: 9pt"><FONT

mujeres negras jefas de familia. El objetivo es devolverle a los afro
descendientes la vivienda que años atrás se les quitó.<BR><SPAN

relacionado con una propuesta de adquirir las casas tapiadas del barrio,
reciclarlas y que las mismas sirvan también como vivienda.<BR><SPAN

muchas veces las mascotas constituyen un tema que genera problema entre vecinos.
En este caso, la comisión está impulsando una campaña de cuidado de las mascotas
lo cual implica, entre otras cosas, que las personas se hagan cargo de limpiar
la materia fecal de sus animales.<BR><SPAN
style="mso-spacerun: yes"> </SPAN>En este sentido, el
viernes</FONT></SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt"><FONT
face="Times New Roman"> 16 </FONT></SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman">de diciembre, la comisión
organizó una jornada recreativa con los niños de la escuela del barrio, en la
plaza Juan Ramón Gómez, ubicada en Durazno y Magallanes. La propuesta consiste
en que los niños expresen a través de dibujos y pinturas, el cuidado y la
higiene de sus mascotas.<BR><SPAN style="mso-spacerun: yes">

style="FONT-SIZE: 9pt; FONT-FAMILY: Arial">Tarea de todos</SPAN></B><SPAN

este grupo, la comisión se enfrentó a distintas dificultades, sobre todo por la
falta de recursos, pero tiene una ventaja y es que al ser concejales cuentan con
la facilidad de actuar como intermediarios con <st1:PersonName w:st="on"
ProductID="la Intendencia Municipal">la Intendencia Municipal</st1:PersonName>
de Montevideo y de acceder a las organizaciones de la zona.<BR><SPAN

ha hecho más fácil y más dinámica desde que los propios vecinos comenzaron a
involucrarse y a colaborar. "La idea no es que nosotros hagamos todo, sino que
la gente se involucre, y haga". Héctor, señaló que con las actividades
realizadas, "nos hemos hecho creíbles y se ha generado un cambio de
