Silveira, Ernesto Rama y Gilberto Vázquez, por el caso del secuestro en
Argentina y asesinato en Uruguay de María Claudia García, esposa del también

jurídicos para remover la ley de caducidad, la cual, en nuestro criterio, está
viciada de <I style="mso-bidi-font-style: normal">nulidad absoluta</I> por ser
violatoria de normas de derecho internacional general <I
style="mso-bidi-font-style: normal">(jus cogens).</I> Dos líneas argumentales
para<SPAN style="mso-spacerun: yes"> </SPAN>ser profundizadas: <I
style="mso-bidi-font-style: normal">la ley de caducidad</I> <I
style="mso-bidi-font-style: normal">es violatoria de la norma de jus cogens que
prohíbe los Crímenes contra <st1:PersonName ProductID="la Humanidad"
w:st="on">la Humanidad</st1:PersonName> y dispone el castigo para sus
responsables</I>; la ley de caducidad es violatoria de normas de jus cogens que
consagran derechos humanos fundamentales.<o:p></o:p></FONT></SPAN></P>

style="FONT-SIZE: 11pt"><SPAN style="mso-spacerun: yes">
</SPAN>¿Qué son las normas de Jus Cogens?</SPAN></I><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"> Son normas de Derecho Internacional General definidas
por <st1:PersonName ProductID="la Convenci?n" w:st="on">la
Convención</st1:PersonName> de Viena sobre el Derecho de los Tratados, como
aquellas normas <I style="mso-bidi-font-style: normal">aceptadas y reconocidas
por la comunidad de Estados en su conjunto</I>, que no admiten acuerdo en
contrario; son normas <I style="mso-bidi-font-style: normal">universales,
imperativas y dinámicas</I> que se encuentran por encima de la voluntad de los
Estados; que no reconocen límites geográficos o humanos para su aplicación; que
se sitúan en el vértice del ordenamiento jurídico; que no pueden ser derogadas
por ningún Tratado, sino únicamente por otras normas de igual naturaleza; <I
style="mso-bidi-font-style: normal">pero lo más importante para el tema que nos
ocupa es que son absolutamente nulos los tratados celebrados en violación de las
mismas y, con más razón, serían absolutamente nulas las leyes de un país
sancionadas en contradicción con sus<SPAN style="mso-spacerun: yes">
</SPAN>preceptos</I>.<o:p></o:p></SPAN></FONT></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>Tengamos presente que la
noción de "<I style="mso-bidi-font-style: normal">crimen contra la
humanidad</I>" no quedó congelada en el Estatuto de Nüremberg, sino que <I
style="mso-bidi-font-style: normal">evolucionó</I>, se <I
style="mso-bidi-font-style: normal">perfeccionó </I>y logró <I
style="mso-bidi-font-style: normal">autonomía</I>; definió sus características
esenciales <I style="mso-bidi-font-style: normal">(imprescriptibilidad,
improcedencia de la amnistía, indulto, gracia, asilo político y refugio)</I> y
se materializó en un principio de derecho internacional general con rango de <I
style="mso-bidi-font-style: normal">jus cogens</I>, por el cual el castigo a los
autores de crímenes contra la humanidad devino un <I
style="mso-bidi-font-style: normal">imperativo
universal</I>.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><FONT
face="Times New Roman"><SPAN lang=ES-UY style="FONT-SIZE: 11pt"><SPAN
style="mso-spacerun: yes"> </SPAN>La existencia de dicha
norma, de naturaleza mixta (fuente consuetudinaria y convencional), ha sido
confirmada por la evolución jurisprudencial y normativa de las últimas décadas:
<I style="mso-bidi-font-style: normal">Convención Interamericana sobre
Desaparición Forzada de Personas</I> (ley</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 10pt"> 16.724, 1995);</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"> <I style="mso-bidi-font-style: normal">Convención sobre
imprescriptibilidad de Crímenes de Guerra y Lesa Humanidad</I> (ley</SPAN><SPAN
lang=ES-UY style="FONT-SIZE: 10pt"> 17.347, 2001);</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"> <I style="mso-bidi-font-style: normal">Estatuto de Roma

lang=ES-UY style="FONT-SIZE: 10pt">, 2005);</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"> jurisprudencia del <I
style="mso-bidi-font-style: normal">Reino Unido</I> (caso Pinochet</SPAN><SPAN
lang=ES-UY style="FONT-SIZE: 10pt">, 1999), etc.<o:p></o:p></SPAN></FONT></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>Quiere decir que al
admitirse la existencia de una norma de <I
style="mso-bidi-font-style: normal">jus cogens</I> que prohíbe el crimen contra
la humanidad y dispone el juzgamiento de los responsables, <I
style="mso-bidi-font-style: normal">concluimos qu</I>e <I
style="mso-bidi-font-style: normal">serían nulas las disposiciones de un Estado
que ampararan la impunidad para los responsables de crímenes contra la
humanidad</I>. Para el caso, <I style="mso-bidi-font-style: normal">sería nula
la ley de caducidad</I>.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>Una segunda argumentación,
con igual conclusión, deriva de analizar los <I
style="mso-bidi-font-style: normal">derechos humanos fundamentales</I> que son
violados por la ley de caducidad.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><FONT
face="Times New Roman"><SPAN lang=ES-UY style="FONT-SIZE: 11pt"><SPAN
style="mso-spacerun: yes"> </SPAN>Recordemos que un año antes
del dictado de esta ley, Uruguay aprueba e incorpora al orden jurídico interno
el <I style="mso-bidi-font-style: normal">Pacto de San José de Costa Rica</I>
(ley</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt"> 15.737).</SPAN><SPAN
lang=ES-UY style="FONT-SIZE: 11pt"> La posterior sanción de la ley de caducidad
violó en forma flagrante derechos fundamentales establecidos en dicho Pacto. La
propia <I style="mso-bidi-font-style: normal">Comisión Interamericana de
Derechos Humanos</I>, órgano de contralor del sistema regional de derechos
humanos, constató y declaró expresamente, en su <I
style="mso-bidi-font-style: normal">Informe</I></SPAN><I
style="mso-bidi-font-style: normal"><SPAN lang=ES-UY style="FONT-SIZE: 10pt">
29/92</SPAN></I><SPAN lang=ES-UY style="FONT-SIZE: 11pt"> que la ley de
caducidad viola los arts</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt">. 1, 8 y
25</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 11pt"> de <st1:PersonName
ProductID="la Convenci?n Interamericana" w:st="on">la Convención
Interamericana</st1:PersonName> de<SPAN style="mso-spacerun: yes">
</SPAN>Derechos Humanos y <I style="mso-bidi-font-style: normal">recomienda al
Estado uruguayo revertir esta situación. </I><SPAN
style="mso-spacerun: yes"> </SPAN>Esta decisión tiene un gran valor
jurídico y político: <I style="mso-bidi-font-style: normal">impone la obligación
al Estado uruguayo de adecuarse a las normas internacionales de derechos humanos
y suprimir el contexto de impunidad</I>. <st1:PersonName
ProductID="la Corte Interamericana" w:st="on">La <I
style="mso-bidi-font-style: normal">Corte Interamericana</I></st1:PersonName><I
style="mso-bidi-font-style: normal"> de Derechos Humanos</I>, por su parte,<I
style="mso-bidi-font-style: normal"> </I>ha entendido que los Estados tienen la
<I style="mso-bidi-font-style: normal">obligación de aplicar las recomendaciones
de <st1:PersonName ProductID="la Comisi?n" w:st="on">la
Comisión</st1:PersonName></I>, ya que al estar referidas a Tratados sobre
derechos humanos fundamentales, el principio de la "buena fe" obliga a cumplir
lo señalado por <st1:PersonName ProductID="la Comisi?n" w:st="on">la
Comisión</st1:PersonName> (Caso Loysa Tamayo</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 10pt">, 1997).<o:p></o:p></SPAN></FONT></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>No perdamos de vista que las
normas sobre derechos humanos que han sido violadas por la ley de caducidad, <I
style="mso-bidi-font-style: normal">son normas de derecho internacional
general</I> con rango de <I style="mso-bidi-font-style: normal">jus cogens</I>
que se imponen a los Estados "erga omnes" y, consecuentemente, puede concluirse
en la nulidad de la ley de impunidad por ser violatoria de las
mismas.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><FONT
face="Times New Roman"><SPAN lang=ES-UY style="FONT-SIZE: 11pt"><SPAN
style="mso-spacerun: yes"> </SPAN>Toda opción política tiene
límites jurídicos y, para el caso, la facultad de amnistiar estaba vedada. Los
"Principios de Cooperación Internacional para <st1:PersonName
ProductID="la Identificaci?n" w:st="on">la Identificación</st1:PersonName>,
Detención, Extradición y Castigo de los Crímenes de Guerra y Lesa Humanidad",
adoptados por Naciones Unidas, paradójicamente en</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 10pt"> 1973,</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 11pt">
disponen que: "<I style="mso-bidi-font-style: normal">Los Estados no tomarán
medidas legislativas o de otra índole, que pudieran ser perjudiciales para las
obligaciones que han asumido en relación con la identificación, detención,
extradición y castigo de los culpables del crímenes de Guerra y Lesa
Humanidad</I>".<o:p></o:p></SPAN></FONT></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>El Estado uruguayo debía
abstenerse de dictar normas de impunidad. ¿Cómo revertir esa situación? <I
style="mso-bidi-font-style: normal">Readecuando el orden jurídico interno al
derecho internacional de los derechos humanos. </I>Si las violaciones a los
derechos humanos perpetradas en su momento por el gobierno uruguayo constituyen
<I style="mso-bidi-font-style: normal">crímenes contra la humanidad</I>, debe <I
style="mso-bidi-font-style: normal">declararse la nulidad de la ley de
caducidad</I>, ya que resulta inadmisible por su <I
style="mso-bidi-font-style: normal">antijuridicidad
intrínseca</I>.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>Hablamos de <I
style="mso-bidi-font-style: normal">declarar la nulidad</I>, no de <I
style="mso-bidi-font-style: normal">derogación</I>. La <I
style="mso-bidi-font-style: normal">nulidad</I> implica declarar la <I
style="mso-bidi-font-style: normal">inexistencia de la norma</I>, esto es: hacer
de cuenta que nunca existió y revertir íntegramente el contexto de
impunidad.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>El Poder Legislativo puede
dictar una ley anulatoria, sin necesidad de mayorías especiales. Diríamos más:
no solamente puede, sino que <I style="mso-bidi-font-style: normal">debe
hacerlo</I> cuando constata un vicio jurídico intrínseco que sería causa de
nulidad absoluta. Debemos entender esto claramente: <I
style="mso-bidi-font-style: normal">no puede anularse cualquier ley, sino
únicamente aquellas que por tener un vicio de tal magnitud, son consideradas
absolutamente nulas para el Derecho.</I><o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><FONT

<st1:PersonName ProductID="La Ley" w:st="on">La <I
style="mso-bidi-font-style: normal">Ley</I></st1:PersonName></SPAN><I
style="mso-bidi-font-style: normal"><SPAN lang=ES-UY style="FONT-SIZE: 10pt">
15.738</SPAN></I><I style="mso-bidi-font-style: normal"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"> </SPAN></I><I style="mso-bidi-font-style: normal"><SPAN
lang=ES-UY style="FONT-SIZE: 10pt">del 22</SPAN></I><I

style="FONT-SIZE: 10pt">,</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 11pt">
declaró la nulidad absoluta y la inexistencia de determinadas "leyes"
sancionadas por el Consejo de Estado, partiendo de la base de que todos los
actos de dicho órgano eran jurídicamente <I
style="mso-bidi-font-style: normal">inexistentes </I>y <I
style="mso-bidi-font-style: normal">absolutamente nulos,</I> por incompetencia y
haber sido dictados al margen de <st1:PersonName ProductID="la Constituci?n. Si"
w:st="on">la Constitución. Si</st1:PersonName> bien la mencionada
Ley</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt"> 15.738 </SPAN><SPAN
lang=ES-UY style="FONT-SIZE: 11pt">convalidó determinadas leyes, derogó y
suspendió otras, también <I style="mso-bidi-font-style: normal">anuló</I>
aquellas que entendió contrarias a los principios democráticos. En su momento,
esta ley de anulación fue impugnada por "inconstitucional", pero <st1:PersonName
ProductID="la Suprema Corte" w:st="on">la Suprema Corte</st1:PersonName> de
Justicia, en Sentencia</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt"> Nº
1</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 11pt"> del</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 10pt"> 3 </SPAN><SPAN lang=ES-UY style="FONT-SIZE: 11pt">de
febrero de</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt"> 1988,</SPAN><SPAN
lang=ES-UY style="FONT-SIZE: 11pt"> la declaró ajustada a
derecho.<o:p></o:p></SPAN></FONT></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>Quiere decir que,
instrumentalmente, es jurídicamente viable la anulación de la ley de caducidad
cuando existen vicios que acarrean la nulidad. En el caso de la ley de
caducidad, se trata de un vicio "material" o de contenido: violentar derechos
inderogables.<o:p></o:p></FONT></SPAN></P>

style="mso-bidi-font-style: normal"><SPAN lang=ES-UY style="FONT-SIZE: 10pt">
25.779 del 21 de</SPAN></I><I style="mso-bidi-font-style: normal"><SPAN
lang=ES-UY style="FONT-SIZE: 11pt"> agosto de</SPAN></I><I
style="mso-bidi-font-style: normal"><SPAN lang=ES-UY style="FONT-SIZE: 10pt">
2003</SPAN></I><SPAN lang=ES-UY style="FONT-SIZE: 10pt">,</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"> declaró "<I
style="mso-bidi-font-style: normal">insanablemente nulas</I>" las leyes de
"obediencia debida" y de “punto final” fundamentándose en el derecho
internacional. Asimismo, <st1:PersonName ProductID="la Corte Interamericana"
w:st="on">la Corte Interamericana</st1:PersonName>, en el caso <I
style="mso-bidi-font-style: normal">Barrios Altos</I></SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 10pt"> (2001)</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 11pt">
y en relación con leyes de autoamnistía que impiden el juzgamiento de crímenes
de lesa humanidad, ha manifestado que las mismas no tienen validez jurídica
alguna a la luz de la normativa del Derecho Internacional de los Derechos
Humanos.<o:p></o:p></SPAN></FONT></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>Entendemos por tanto
perfectamente transitable el camino de la anulación de la ley de caducidad, para
el cual existen sobrados argumentos jurídicos.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>Conceptualmente, debe quedar
fuera de todo margen de duda que, si la categorización de las violaciones
ocurridas en el Uruguay califican como <I
style="mso-bidi-font-style: normal">crímenes contra la humanidad</I>, <I
style="mso-bidi-font-style: normal">la anulación de la ley de caducidad se
impone por mandato del Derecho.<o:p></o:p></I></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><FONT
face="Times New Roman"><SPAN lang=ES-UY style="FONT-SIZE: 11pt"><SPAN
style="mso-spacerun: yes"> </SPAN>No debe escapar a la
reflexión, la problemática de la cosa juzgada o de la retroactividad de la ley
penal más grave, ante un escenario de anulación de la ley de caducidad. Tengamos
presente que debemos aplicar los principios del derecho internacional de los
derechos humanos para crímenes contra la humanidad o violaciones graves a los
derechos humanos, resultando<SPAN style="mso-spacerun: yes"> </SPAN>por
demás ilustrativa la sentencia del caso Simón de <st1:PersonName
ProductID="la Corte Suprema" w:st="on">la Corte Suprema</st1:PersonName> de
Justicia Argentina, del</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt"> 14
</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 11pt">de junio de</SPAN><SPAN
lang=ES-UY style="FONT-SIZE: 10pt"> 2005 (S. 1767. XXXVIII, causa 17.768,
párrafo 31): "<I style="mso-bidi-font-style: normal">(…)</I></SPAN><I
style="mso-bidi-font-style: normal"><SPAN lang=ES-UY style="FONT-SIZE: 11pt"> la
supresión de las leyes de punto final y de obediencia debida resulta
impostergable y ha de producirse de tal forma que no pueda derivarse de ellas
obstáculo normativo alguno para la persecución de hechos como los que
constituyen el objeto de la presente causa. Esto significa que quienes
resultaron beneficiarios de tales leyes no pueden invocar ni la prohibición de
retroactividad de la ley penal más grave ni la cosa juzgada. Pues, de acuerdo
con lo establecido por <st1:PersonName ProductID="la Corte Interamericana"
w:st="on">la Corte Interamericana</st1:PersonName> en los casos citados, tales
principios no pueden convertirse en el impedimento para la anulación de las
leyes mencionadas ni para la prosecución de las causas que fenecieron en razón
de ellas, ni la de toda otra que hubiera debido iniciarse y no lo haya sido
nunca. En otras palabras, la sujeción del Estado argentino a la jurisdicción
interamericana impide que el principio de "irretroactividad" de la ley penal sea
invocado para incumplir los deberes asumidos en materia de persecución de
violaciones graves a los derechos humanos.</SPAN></I><SPAN lang=ES-UY
style="FONT-SIZE: 11pt">" <o:p></o:p></SPAN></FONT></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>Proseguir con el análisis
del tema nos obliga a referirnos a un aspecto histórico, jurídico y político de
gran importancia: la ley de caducidad fue respaldada por un referéndum popular,
el cual <I style="mso-bidi-font-style: normal">si bien no le quitó su
antijuridicidad, le otorgó un respaldo mayoritario en un momento
determinado</I>. Primaron las razones de conveniencia política, por sobre el
mandato jurídico de los derechos humanos.<SPAN style="mso-spacerun: yes">
</SPAN>El hecho de que la ley fuera confirmada por un referéndum, le otorgó
sustentabilidad política pero no modificó cualitativamente su contenido
antijurídico. La ley de caducidad no cambió su naturaleza jurídica por el
referéndum: si nació nula, sigue siendo nula y anulable por otra
ley.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>No me canso de repetir un
ejemplo: si por votación popular estableciéramos la esclavitud, <I
style="mso-bidi-font-style: normal">¿estaríamos sancionando una norma
substancialmente válida?</I> No. Sería nula; absolutamente nula por ir contra
normas y principios de derechos humanos <I
style="mso-bidi-font-style: normal">que se encuentran por encima de la
disponibilidad de los Estados</I>; sería nula aunque contara con respaldo
político y social -más allá de que indicaría el grado de deterioro social al que
habríamos llegado-.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>En el convencimiento de que
la anulación de la ley de caducidad tiene, como venimos de exponer, un
contundente fundamento jurídico, será indispensable que la sociedad en su
conjunto reflexione sobre esta posible opción.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>Tengamos presente que en los
procesos de reestablecimiento democrático de América Latina, finalizadas las
dictaduras militares de décadas pasadas, las sociedades se enfrentaron al
desafío de dar respuesta a las violaciones sistemáticas de los derechos humanos
perpetradas por el Estado. En dicha instancia, fue una constante advertir que
los militares no solamente no mostraron su arrepentimiento, sino que tampoco
reconocieron su participación y responsabilidad; por el contrario, negaron los
hechos, les restaron importancia o bien los calificaron como actos aislados,
confiados en que el poder real y efectivo que en la realidad mantenían, fuese
visto por los políticos de la época, como un elemento de disuasión, presión y
amenaza.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>En este contexto, la sanción
de la ley de caducidad -como en otros países las leyes de punto final- implicó
una solución política ciega al Derecho, constituyéndose en instrumento para el
ocultamiento de las violaciones a los derechos humanos ocurridas y para la
impunidad de sus autores.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>Existen, sin embargo,
momentos históricos que son verdaderos puntos de
inflexión.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><FONT
face="Times New Roman"><SPAN lang=ES-UY style="FONT-SIZE: 11pt"><SPAN
style="mso-spacerun: yes"> </SPAN>La política que se viene
implementando desde el 1 de marzo de</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 10pt"> 2005 </SPAN><SPAN lang=ES-UY style="FONT-SIZE: 11pt">en
relación con <st1:PersonName ProductID="la Verdad" w:st="on">la
Verdad</st1:PersonName> y <st1:PersonName ProductID="la Memoria" w:st="on">la
Memoria</st1:PersonName>, ha aportado avances significativos, fundamentalmente,
al dejar en evidencia las atrocidades de la dictadura, ocultadas durante
décadas.<o:p></o:p></SPAN></FONT></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><FONT
face="Times New Roman"><SPAN lang=ES-UY style="FONT-SIZE: 11pt"><SPAN
style="mso-spacerun: yes"> </SPAN>Aun sin mucha perspectiva
histórica -por su inmediatez-, podríamos calificar al período transcurrido desde
marzo de</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt"> 1985 </SPAN><SPAN
lang=ES-UY style="FONT-SIZE: 11pt">hasta de febrero de</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 10pt"> 2005,</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 11pt">
como un mero "tiempo de transición" en materia de derechos
humanos.<o:p></o:p></SPAN></FONT></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>Hoy vivimos una nueva etapa
en la cual la sociedad comienza a enfrentar, descarnadamente, su pasado; recién
está comenzando a conocerlo. No fueron actos aislados o desvíos sin importancia.
Se comprueba una violación sistemática de los derechos humanos, coordinada bajo
el "Plan Cóndor".<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>Sin margen para la duda,
puede afirmarse que existieron crímenes de lesa
humanidad.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>Por consiguiente, nadie
puede quitarle al pleno social la legitimidad de debatir sobre estos hechos, en
la búsqueda de una actitud definitiva a ser adoptada frente a la violación de
los derechos humanos ocurrida durante la dictadura.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>En el marco de dicho debate,
debería reconocerse que la sanción de la ley de caducidad fue una solución
equivocada en lo jurídico, pero también en político y en lo
ético.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>La consolidación definitiva
y substancial del<SPAN style="mso-spacerun: yes"> </SPAN><st1:PersonName
w:st="on">Estado de Derecho</st1:PersonName> implica que la sociedad en su
conjunto, asuma que <st1:PersonName ProductID="la Justicia" w:st="on">la
Justicia</st1:PersonName> es un elemento innegociable del modelo cultural
inherente a la democracia, cuando se trata de dar respuesta a situaciones que
califican como "crímenes de lesa humanidad".<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><FONT
face="Times New Roman"><SPAN lang=ES-UY style="FONT-SIZE: 11pt"><SPAN
style="mso-spacerun: yes"> </SPAN>Escribimos hace veinte años
lo que hoy mantiene plena vigencia</SPAN><SPAN lang=ES-TRAD

Ruiz, y de los militantes izquierdistas Rosario Barredo y William Withelau,
sostuvieron el reclamo de verdad y justicia aún en tiempos que el mismo parecía
inalcanzable.<o:p></o:p></SPAN></FONT></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>La llegada del Frente Amplio
al gobierno marcó un claro cambio en la indiferencia y complicidad de las
administraciones anteriores con respecto a los crímenes de la dictadura.
Exclusiones de mandos y casos de <st1:PersonName ProductID="La Ley" w:st="on">la
Ley</st1:PersonName> de Impunidad, ingreso a los cuarteles en búsqueda de fosas
clandestinas y el hallazgo de algunos restos de desaparecidos son relevantes.
También las directivas para que la justicia no se descansara en el gobierno a la
hora de investigar hechos, de lo cual se eximía siempre preguntando primero si
el evento estaba comprendido o no en la impunidad al gobernante de
turno.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>Ahora el Dr. Tabaré Vázquez
le pide a la justicia que investigue primero y luego llegará la determinación
oficial. Pero el camino es largo y queda mucho en avanzar. El gobierno se
comprometió en la campaña a respetar <st1:PersonName ProductID="la Caducidad"
w:st="on">la Caducidad</st1:PersonName>, pero haciendo cumplir todos los
artículos de la misma, incluso los que obligaban a investigar. Sin embargo,
viene creciendo en distintos ámbitos la sensación de que llegó la hora de anular
la ley, intrínsecamente nula, por más que hubiera sido aprobada en un referéndum
signado por el temor y las amenazas de un nuevo
golpe.<o:p></o:p></FONT></SPAN></P>
<P class=MsoNormal style="MARGIN: 0cm 0cm 0pt"><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"><FONT face="Times New Roman"><SPAN
style="mso-spacerun: yes"> </SPAN>Este 20 de mayo, miles de
personas marcharan en silencio cuando, por primera vez, varios torturadores y
asesinos están presos y sometidos a proceso. Cuando algunos fueron extraditados
a Chile y otros lo serían a <st1:PersonName ProductID="la Argentina. En"
w:st="on">la Argentina. En</st1:PersonName> este sentido, </FONT><A
href="http://www.larepublica.com.uy/lr3/?a=nota&n=211316&e=2006-05-19"><FONT
face="Times New Roman">el periodista Roger Rodríguez informa en el diario La
República que los tres jueces federales argentinos que investigan crímenes de
lesa humanidad en el marco del Plan Cóndor, "analizan realizar un 'megajuicio'
contra los cinco militares y el policía uruguayos detenidos en Montevideo, en
trámite de extradición"</FONT></A><FONT face="Times New Roman">. Los mismos
represores están involucrados en varios casos, y operaron en distintos centros
clandestinos de tortura argentinos. Bien podría incluirse a los mandos militares
que en una carta pública asumieron la responsabilidad de los hechos cometidos
por sus subordinados. No está claro si esos hechos incluyen los llamados
"excesos" (torturas, violaciones, asesinatos,, etc., etc.). No está claro si el
valor les da para tanto, lo que si se encargó de aclarar el ex dictador Gregorio
"Goyo" Álvarez, es que para nada la carta implica un "mea culpa" y que de
ninguna manera está dispuesto a pedir perdón, es decir, de arrepentimiento...
nada. Abogados defensores de los derechos humanos sumarán la carta a las pruebas
que someterán a <st1:PersonName ProductID="la Justicia" w:st="on">la
Justicia</st1:PersonName> en una demanda a los mandos militares. Aunque sería la
propia Justicia la que tendría que tomar cartas en el asunto de oficio,
rompiendo su triste inercia. A 30 años de las muertes en Argentina, el
estruendoso silencio se apoderará de <st1:PersonName ProductID="la Av."
w:st="on">la<SPAN style="FONT-SIZE: 10pt"> Av.</SPAN></st1:PersonName><SPAN
style="FONT-SIZE: 10pt"> 18</SPAN> de Julio, el centro de la

homenaje a Zelmar Michelini y Héctor Gutiérrez Ruiz, actividad promovida por

Nacional</st1:PersonName> de Cultura y <st1:PersonName ProductID="la Direcci?n"
w:st="on">la Dirección</st1:PersonName> de Derechos Humanos del Ministerio de
Educación y Cultura, en coordinación con el Poder Legislativo. La muestra,
realizada a la memoria de los parlamentarios pretende incentivar el rescate de
acontecimientos del pasado reciente, "generalmente ignorados en su significación
- señalaron los organizadores- por parte del pueblo

pública de la derrota del movimiento que impulsaba la derogación de

de los hechos el recuerdo volvió a ganar relevancia de la mano del nuevo interés
público por el tema de las violaciones a los Derechos Humanos durante la
dictadura. Así Rafael Michelini invitó a los organismos de Derechos Humanos, a
organizaciones sociales y Partidos Políticos a una manifestación en reclamo del
esclarecimiento de la situación de los desaparecidos. El resultado fue la
multitudinaria marcha del</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt"> 20
</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 11pt">de mayo de</SPAN><SPAN

vivió su niñez en Los Olivos, un barrio chiquito y poco conocido entre el
Hipódromo y Las Acacias. A comienzos de la década del</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 10pt"> 60 </SPAN><SPAN lang=ES-UY style="FONT-SIZE: 11pt">los
chiquilines se arremolinaban tras la pelota en plena calle, pero otro deporte,
el box, también atraía multitudes, era la época en que el ídolo indiscutido era
Dogomar Martínez. Floreal no había cumplido los 16 años cuando le calzaron un
brillante par de guantes, y con ellos llegó muy alto: fue campeón uruguayo,
entró tercero en el Latinoamericano y logró <st1:PersonName
ProductID="la Medalla" w:st="on">la Medalla</st1:PersonName> de Oro y el título
de Campeón Panamericano en</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt">

style="FONT-SIZE: 11pt"> Fueron años gloriosos, de trompadas, de abrazos y de
relucientes trofeos. La vida parecía sonreír, pero sin embargo serían otros
caminos -mucho más trágicos- los que iba a recorrer aquel muchacho nacido
para luchar<BR><SPAN style="mso-spacerun: yes"> </SPAN>El
deporte de los puños atraía a los jóvenes, que ansiaban tirar la piña y entrenar
en algún club. "Si no te sabías defender, la quedabas".<BR><SPAN

uno de esos chiquilines, pero sus éxitos lo llevaron a trascender fronteras. Fue
Campeón Uruguayo en su categoría (Mosca), luego en Argentina compitió en el
Campeonato Latinoamericano y salió tercero. Pero su mayor logro lo consiguió
el</SPAN><SPAN lang=ES-UY style="FONT-SIZE: 10pt"> 4</SPAN><SPAN lang=ES-UY
style="FONT-SIZE: 11pt"> de mayo de</SPAN><SPAN lang=ES-UY

realizarían las Olimpíadas en Tokio. Floreal era el candidato natural para
representar a Uruguay, pero poco antes de la partida ocurrió lo inesperado: el
